These Terms of Service govern the use of the website https://zadarboattrip.com (“Website”), which is owned and operated by TRLJICA, obrt za trgovinu i ribarstvo, vl. Edita Čikarela, with its registered place of business at Stjepana Radića 42 C, 23000 Zadar, Croatia (“Company”, “we”, “us”, or “our”). By accessing the Website, purchasing tickets, or participating in any of the excursions advertised, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with any part of these Terms, you should discontinue use of the Website.
1. Services Provided
The Company provides organized boat excursions and related tourism services operating from Zadar and surrounding areas. All information regarding tours, schedules, departure locations, pricing, and availability is published on the Website. The Company reserves the right to modify or update available services at any time without prior notice, provided that such changes do not affect confirmed bookings.
2. Booking and Payment
All bookings made through the Website are processed via TixTree, our authorized ticketing and payment partner. Payments submitted electronically are handled securely by TixTree using Stripe as the underlying payment processor. The Company does not handle, process, or store any credit or debit card information. Your booking is considered confirmed upon successful payment processing and issuance of a confirmation message or email through TixTree. You are responsible for ensuring the accuracy of all information submitted during the booking process.
3. Pricing
All prices for excursions are listed in euros (EUR) and include applicable taxes unless indicated otherwise. The Company reserves the right to update or modify pricing for future bookings at any time. Pricing changes do not apply retroactively and will not affect reservations that have already been confirmed.
4. Cancellation and Refunds
Guests may cancel their booking at any time; however, refunds will be granted only if the cancellation is submitted at least 24 hours prior to the scheduled departure time. Cancellations made within 24 hours of departure are not eligible for a refund. Failure to appear at the designated meeting point before departure, for any reason, will be treated as a “no-show” and will not qualify for compensation or refund.
In circumstances where the Company must cancel or postpone an excursion due to severe weather conditions, operational issues, safety concerns, or other circumstances beyond our control, affected guests will be offered the choice of either a full refund or the option to reschedule the excursion to another available date. Refunds are processed solely through TixTree and Stripe and are issued to the original payment method.
5. Customer Responsibilities
By booking a tour, guests agree to arrive at the designated meeting point at least 15–20 minutes prior to departure. Guests are required to comply with all safety instructions provided by the crew, including but not limited to the use of safety equipment, seating arrangements, and conduct during the excursion. Participation in boat excursions may involve inherent risks associated with maritime travel, and guests acknowledge and accept these risks. Guests must inform the Company of any medical conditions or special requirements prior to boarding.
The Company reserves the right to refuse service to any individual whose behavior compromises the safety, comfort, or experience of other guests or crew members.
6. Limitation of Liability
To the fullest extent permitted under applicable law, the Company disclaims liability for any indirect, incidental, or consequential damages arising from participation in excursions or the use of the Website. The Company is not responsible for loss, theft, or damage to personal belongings, nor for injuries resulting from disregard of crew instructions or misuse of equipment. While all reasonable safety measures are in place, participation in excursions is ultimately at the guest’s own risk.
7. Intellectual Property
All text, images, graphics, videos, and other content displayed on the Website are the intellectual property of the Company unless otherwise stated. Unauthorized reproduction, distribution, modification, or digital or physical reuse of Website content is strictly prohibited without the Company’s prior written consent.
8. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Croatia. Any disputes arising from these Terms or related services shall be subject to the exclusive jurisdiction of the competent courts located in Zadar, Croatia.
